Repair & Warranty

New Product Warranty

This Limited Warranty (“Warranty”) is for the initial retail owner of the Product (the “End Customer”) and shall not be assigned or transferred without Universal Avionics Systems Corporation’s (“Universal”) prior written consent. This Warranty Certificate must be completed and returned to Universal for the warranty to become effective.

Universal warrants that each part listed in this Warranty Certificate (the “Product”) will be free of defects in workmanship or material for a period of twenty-four (24) months from the date the Product and aircraft in which it is installed are put into service not to exceed thirty (30) months from the date of shipment (“Warranty Period”). In the event Universal has not received a properly executed Warranty Certificate, then the Warranty Period shall be twenty-four (24) months from the date of shipment. During the Warranty Period Universal will correct these defects by repair or replacement at Universal’s sole option and expense, provided that:

  1. Previous maintenance or repair, installation, handling, transportation, storage, operation and/or use of the Product was performed in compliance with Universal’s instructions;
  2. The Product has not been altered, modified, or repaired other than by Universal, or a dealer or service and repair center that has been authorized by Universal;
  3. The Product was installed by an aircraft manufacturer, or a dealer or service and repair center that has been authorized by Universal; and
  4. Written notice of the Product defect is given to Universal, or a dealer or service and repair center that has been authorized by Universal, within the specified Warranty Period.

 

End Customer shall be solely responsible for the costs associated with removal or reinstallation of the Product, and shipment to the repair facility which are expressly excluded under this Warranty. Universal will pay for second day air shipping for return of the repaired or replaced Product to End Customer.

All Products repaired or replaced hereunder shall be warranted in accordance with the terms of this Warranty for the remaining unexpired portion of the Warranty Period, only. In the event the Product is no longer being manufactured by Universal, Universal, in its sole discretion, will either substitute a successor product (of the equivalent or improved quality and specification) or refund End Customer Universal’s standard price of the Product at the time of purchase.

DISCLAIMER. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER WRITTEN OR ORAL, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ALL OF WHICH ARE HEREBY EXPRESSLY DISCLAIMED. NO EXTENSION OR EXPANSION OF THIS WARRANTY SHALL BE BINDING UPON UNIVERSAL UNLESS SET FORTH IN WRITING AND SIGNED BY AN AUTHORIZED REPRESENTATIVE OF UNIVERSAL.

LIMITATION OF LIABILITY. IN NO EVENT SHALL UNIVERSAL BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES UNDER THIS WARRANTY EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES INCLUDING, WITHOUT LIMITATION, INTERRUPTION OF BUSINESS, LOSS OF PROFITS, OR LOSS OF USE. THE EXCLUSION OF INCIDENTAL AND CONSEQUENTIAL DAMAGES AS SET FORTH IN THIS WARRANTY SHALL BE DEEMED INDEPENDENT OF, AND SHALL SURVIVE, ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY UNDER THE TERMS OF THIS WARRANTY. UNIVERSAL’S AGGREGATE LIABILITY ON ANY CLAIM FOR LOSS OR DAMAGE ARISING OUT OF, CONNECTED WITH, OR RESULTING FROM THIS WARRANTY, OR FROM THE PERFORMANCE OR BREACH THEREOF, OR FROM THE MANUFACTURE, SALE, DELIVERY, RESALE, REPAIR OR USE OF ANY PRODUCT OR SERVICE COVERED BY OR FURNISHED UNDER THIS WARRANTY SHALL IN NO EVENT EXCEED UNIVERSAL’S STANDARD PRICE OF THE PRODUCT, AT THE TIME OF PURCHASE, WHICH GIVES RISE TO THE CLAIM.

This Warranty is intended as the exclusive remedy of End Customer with respect to any claim relating to the Products, whether arising at law or at equity.

This Warranty shall be governed in all respects by the laws of the United States of America and the State of Arizona without regard to conflicts of law principles. The Parties agree that the United Nations Convention on Contracts for the International Sale of Goods is specifically excluded from application to the Warranty. All disputes arising under the Warranty shall be brought in Superior Court of the State of Arizona in Pima County or the Federal District Court of Tucson, Arizona. Such courts shall have sole jurisdiction over any disputes under the Warranty, and the parties hereby consent to the personal jurisdiction of such courts.

Universal Avionics’ FlightAssure Extended Warranty Program removes the uncertainty and guesswork from your avionics’ maintenance, downtime, and repair costs in the event of a failure.

Fleet Operators

FlightAssure Fleet is designed for airline and other various fleet operators where a cost per flight hour structure is imperative. The program allows for repair, replacement and overhaul services and products. The maintenance agreement is billed monthly, based on a flat fee per flight hour.

 

Essential / Premier for Business Operators

The Essential and Premier programs offer a flat rate contract, which is ideal for business aviation operators. It features a straightforward, 3-year fixed-price contract billed annually to allow for improved yearly planning and certainty. With FlightAssure, you receive one invoice at the start of your contract, and renewed annually. The contract is fully transferable.

Removal and refit coverage is provided at no additional cost through an Authorized Dealer. Universal Avionics partners with several hundred Authorized Dealers worldwide and registers new installation centers on a regular basis, ensuring worldwide access to qualified repair technicians.

FlightAssure Premier offers additional coverage for a nominal increase to the annual fee. It includes Unlimited NFFs, Counter-to-Counter shipments, extended troubleshooting service, technical publications and discounts for FMS software upgrades.

Rentals, Loaners, Exchanges

Rentals, Loaners & Exchange units are available upon request.

If your unit experiences a failure, and is still under our two year new product factory warranty, you are eligible to receive a no-charge loaner unit while yours is in for repair. You also have the option of ordering a no-charge warranty exchange unit.

Customers who have a unit that experiences failure and is no longer covered under our two year new product factory warranty can obtain a rental unit while their unit is sent in for repair. They can also opt to order a non-warranty exchange unit.
